The Reason Why Buddha Images, Artifacts, and Antiques are Restricted Items

Buddha images (Antiques not New), artistic artifacts, and antiques are considered “Restricted Items” or “Controlled Goods” under the laws governing the import and export of goods out of the Kingdom of Thailand. This is because they represent the cultural heritage and valuable national treasures of Thailand, which must be conserved and preserved to prevent their loss from Thai soil.

The Main Objectives of Control

  • Preventing Smuggling: To prevent the illegal removal of these items from the country, which would result in the loss of historical, archaeological, and artistic evidence showcasing the nation’s civilized prosperity.
  • Preserving National Property: Certain exceptionally valuable antiques or artifacts are considered property of the state under the Ancient Monuments, Antiques, Art Objects and National Museums Act B.E. 2504 (1961), as amended.
  • Controlling Trade and Possession: To ensure systematic control and inspection of the ownership, trade, and movement of these objects, preventing their destruction or alteration.

Relevant Legislation

  • The Ancient Monuments, Antiques, Art Objects and National Museums Act B.E. 2504 (1961): This is the main law granting the Fine Arts Department the authority to control and permit the export or import of such items, especially those that have been registered (Sections 22 and 39).
  • Notifications of the Ministry of Commerce and the Fine Arts Department: These specify the list and conditions for goods that are restricted, stipulating that Buddha images, deity images, and their fragments are items that require an export permit approved by the Fine Arts Department.
  • Customs Law: Mandates that anyone intending to import or export these restricted goods must obtain written permission from the relevant government agency (e.g., the Fine Arts Department) and must present this authorization during customs clearance procedures.

Important Export Restrictions

Certain types of antiques or art objects are strictly prohibited from being exported out of the Kingdom, such as antiques aged over 50 years or items that are incomplete or damaged (unless specifically permitted for temporary removal for study or exhibition purposes).
